Zam Trader is a product of Will Win International Limited: a company incorporated in The Republic of Zambia and meeting the provisions of the Zambian Company laws - Zam Trader is therefore, until otherwise expressed from time to time, wholly owned by Will Win International Limited;
The Zam Trader portal is a portal made for profit and whereas listings are rendered for free, any sales emanating from this service or website, will command a commission to be deducted from the selling price listed by the seller; The seller is any person listing a product or service for some form of gain on this website - a gain can be a tangible gain, or a virtual (intangible) gain such as ‘peace of mind’ service (as an example) as long as a monetary return is gained;
The buyer is any person using this site to acquire (at a cost, if it so states) a product or service from this website.
Responsibilities of the Seller
1. The seller is duty-bound and has the responsibility to accurately provide truthful information on the condition of goods they upload onto this site for onward sale;
2. Under no circumstances will regulated products (such as guns or scheduled drugs) or prohibited substances or materials are to be sold or uploaded onto the site for sale or distribution to another party known or unknown to the incumbent uploading content;
3. We are duty-bound to assist any law enforcement agency for misrepresentations and crimes committed through the use of this site - we will therefore hope that all the goods sold are legally the sellers or a sellers appointed proxy. Zam Trader will not be held responsible for determining whether goods advertised here are of good standing and it will be the responsibility of both seller and buyer to ensure that proper, genuine and bona fide trading transactions are finalized to each incumbents content - discernment and a level of due-diligence by the buyer withstanding;
4. It is every sellers responsibility to ensure that their products (especially) meet their respective descriptions when presented for sale - the website provides a guideline with some options on what some of these descriptions may be (see the drop down menus on the website) - should some important product detail need adding (because it does not occur per description) - the seller must use the provided ‘additional information’ or ‘comment’ fields to add additional information vis-a-vis the goods being offered for sale;
5. The seller needs to give information as accurately as possible on their money-receiving details as our agency cannot be held responsible for any incorrect data provided;
6. To set prices in a fair unviolated manner - should premium goods be offered, the seller must provide additional details to this effect in a genuine, truthful manner - this is important because no counterfeit products can be allowed - anything outside this fact will have to be stated if known in advance;
7. Sellers will abide by the Zam Traders condition of sale, whether these be fees for tax purposes as well as commissions applicable - sellers also have the right to know what these additional selling costs are and can use the provided applicator to determine a ‘ghost’ outcome of sale.
Responsibilities of the buyer
i. The buyer has the responsibility to ensure that they satisfy themselves with the products they intend to buy - ensure that you closely understand what is being offered and inspect any additional information or comments on the items being offered for sale;
ii. Can report any goods or services that are deemed to be of an inappropriate nature - review Annexure A below, on goods or services that are considered in the list of prohibited items - these may change depending on changes in legislation from time to time;
iii. The buyer has the responsibility to pay for the items advertised in full at the price indicated on the item;
iv. Should returns need to be made, proper reasons need to be provided as the buyer will be responsible for costs of returns and other handling fees that will be adjudged in the remediating, emanating processes;
v. Any ‘addressing’ and other personal information requested, will solely be for the purposes of convenience for or to this service, or otherwise for remediation purposes and both buyer and sellers will be required to sign a disclaimer recognizing these facts;
vi. Should the buyer not receive items bought, they can contact our consumer desk - it is expected that items not received will be supported by evidenced-documents - for example if we receive documentation with a receipt form returned to us, then this is considered goods delivered and cannot be claimed for;
vii. Provide and act in a way expected of a purchaser - that you are above the applicable age, possess the relevant National Registration Documents or acceptable ID and that if buying for a third-party, appropriate approvals have been obtained by the actual buyer.
